Downloads.exe.11.7.5.A US Supreme Court ruling that upheld controversial “stand your ground” laws — which allow people to use deadly force if they feel their life is in danger — pushed the country one step closer to a civil war.
The new ruling, which Justice Antonin Scalia said should be considered “a modest proposal” to help citizens defend themselves, came on the heels of an historic Supreme Court case from 2005, when the court ruled that in certain situations a defendant’s perceived threat of death or serious bodily harm was justified if a licensed gun owner could reasonably say that he or she feared for their life or that of others.

A federal appeals court, in two separate rulings, expanded the ruling by saying, among other things, that the so-called “stand your ground” law, passed by the Florida Legislature in 2005, was constitutional, in cases where the defendant engaged in deadly force without a legal basis.
The rulings were in response to two shootings: the slaying of unarmed teen Trayvon Martin in Miami; and the 2012 shooting of a fisherman in Wisconsin who was cleaning his gun in a yard where he had once seen a suspicious figure.
The 5-to-4 ruling of the Supreme Court on Monday was the result of an appeal by the two Florida men.
Their lawyers argued that the judge in the Martin case made a mistake by telling jurors that while “stand your ground” meant that a defendant could have a reasonable fear for his or her life, it did not give a person the right to “take the law into his own hands.”
Justice Ruth Bader Ginsburg wrote the opinion for the court, which says that people have a right to shoot someone who is threatening them with death or serious injury.

“The court held that the Florida law is constitutional, because the statute does not limit the right to use lethal force to situations where the actor was engaged in criminal activity or where the victim was threatening the life of the actor,” the decision said.
“The statute contains an important purpose: to reduce the lethality of firearms in the hands of those who have had previous interactions with law enforcement or the criminal justice system.”
