At issue in the case are the FCC chairman’s 2007 and 2011 resignations from the U.S. Foreign Intelligence Advisory Board. In 2011, Edward Roybal resigned after the Federal Trade Commission launched a probe of the Board for potential violations of the Hatch Act. But Ed Gray continued as chairman until January, 2012, when he was officially replaced by Thomas Wheeler.
Wheeler has now concluded that Gray violated the Hatch Act “by using his position to benefit a political campaign.” The Hatch Act requires government employees to relinquish their positions upon appointment to another office.
Wheeler’s conclusion was based on a 12-page memo by FTC Special Counsel Steven Berry that looked at whether Gray improperly used his FEC-funded board seats to campaign for Republican candidates.
“He did not resign voluntarily,” Wheeler wrote. “As the law requires, he was removed. There is no principled distinction between his conduct and the conduct that led to the removal of the previous FCC Chairman for violation of this statute. Accordingly, I have concluded that Mr. Gray violated the Hatch Act.”
Wheeler further noted in his decision that, “By remaining on the Board when he should have resigned, he continued to benefit Mr. Lott.” Lott is the former North Carolina senator who was chairman of the House GOP conference when the Hatch Act investigation was initiated.
The FCC does not have the authority to remove a commissioner from office, but has the ability to suspend commissioners. Wheeler writes that he has “suspended Mr. Gray from further service” and that the rules still need to be determined “as to what specific consequences, if any, may follow that suspension.”
Meanwhile, Wheeler wrote, he “will consider as a matter of policy the question of whether to seek an order permanently barring Mr. Gray from further service under the Hatch Act.”
Both Gray and Wheeler’s predecessor, former FCC Chairman Julius Genachowski, were targeted by the FTC because of their FCC positions and their leadership of the supposedly non-partisan commission.
