the gss data were used to estimate the total number of songs downloaded via p2p networks. however, p2p users may not download the entire song. for example, the gss data indicate that only 7% of p2p users download at least half of a song. thus, the gss data are not directly comparable to the data collected by the riaa and musicwatch. nevertheless, these data can be used to test the validity of the riaa and musicwatch data. if p2p users are more likely to download a song, the riaa and musicwatch data should be higher than the gss data.
krause et al. ( 2006 ) conducted a study of file sharing on napster. they found that p2p users are less likely to download the entire song than non-p2p users. they also found that p2p users are more likely to download songs with a small fan base. as table 1 shows, krause et al. ( 2006 ) did not report the number of files downloaded by p2p users. therefore, it is not possible to say whether p2p users download more or fewer songs than non-p2p users.
in this section, we will identify two methods to download the data as table s1. the first method uses our online software download tool and the second uses the package on r. the data are available as a supporting material to this paper. we are also sharing the raw data on the p2p-h.org website.
in short, the bittorrent protocol has made file sharing accessible to a wider range of users. it has also improved the user experience and allowed for more efficient sharing. the way that bittorrent has altered the file sharing experience is an important factor in its continued growth. several other protocols, like gnutella, continue to be used by some users and have spawned clones. but bittorrent, after several years of development, has become the dominant file sharing protocol, supported by most of the largest torrent sites. the torrent sites are a large part of the bittorrent ecosystem. they act as repositories of both the files and the users who download them. these repositories are of interest to copyright owners because they reduce some of the risks inherent in selling digital products. selling a physical good is much easier than selling a file. the first step is to find a potential buyer, and this process is expensive and cumbersome. to solve this problem, sellers in the music industry have started to sell their wares through these torrent sites, with the help of bittorrent.
as of mid-2006, bittorrent accounted for about one percent of all internet traffic. a 2002 study showed that a typical file was downloaded using bittorrent about 100 times over the course of a year (mills and ames 2006). but of course, the number of downloads can only increase as other network technologies enter the marketplace. as of mid-2006, peer-to-peer file sharing accounted for about a third of the daily traffic on kazaa, the most popular internet filesharing network. kazaa is the dominant peer-to-peer file sharing network in the united states and europe, where it accounts for 70% of total downloads (greenbaum 2006). while a large number of people are downloading music and video files using kazaa, its user base is fairly small (2.2 million, as of mid-2006). the number of active users is increasing, however, as more people join the network. twenty percent of active kazaa users are from outside the united states, indicating a fairly strong international dimension to the network.
the story of kazaa is much different than that of the riaa. while kazaa files are shared on a peer-to-peer basis, the riaa and other recording industry organizations have tried to suppress peer-to-peer file sharing. a number of companies that provide internet connectivity to homes and businesses have tried to stop their customers from sharing files using kazaa. in august 2003, the music company sony bmg, the riaa, the recording industry association of america, the music companies bertelsmann and bmg, and the international intellectual property alliance (iipa) tried to force the popular kazaa file sharing network to stop distributing music on p2p networks. they filed a lawsuit under the digital millennium copyright act (dmca) against kazaa. the suit claimed that the sharing of music files by kazaa users violated copyright law. but the central problem for the recording industry was that they were unable to distinguish between legitimate filesharing and illegal file sharing. according to the legal definition, kazaa is illegal because it allows users to share copyrighted material, but it is not illegal if a user chooses to download the copyrighted material, or if a user does not pay for a copy of the copyrighted material.
