I watched hours of press conferences and interviews Wednesday with White House officials and congressional leaders as Congress worked through dozens of problems with implementation of the new health-care law. The questions were so numerous, and the answers so ad hoc that they masked the real story of just how the president of the United States had abdicated his executive authority on health care.
Fellow Reformed Baptist – and godson – Jack Riley reported that the president’s press secretary told him the president “has a right to weigh in, and he’ll weigh in, on how the law is working.” As the reviews have poured in, the president only has made his own choices on health care.
Ben Rice, the president’s chief of staff, stated Thursday morning that the president “has the right to be involved.” And Sean Spicer, the communications director, said the president “will be going around town talking about the Affordable Care Act.”
In his daily news briefings and his interviews, the president has either ignored questions about the implementation, or, when he has, he has said what he thinks he wants to be the case. In one notable exception, he has let his press secretary, Sean Spicer, and Health and Human Services Secretary Tom Price, take the blame for the out-of-sequence roll out of the new law.
I have no doubt that the president would push for his agenda in any forum, but it is becoming a pattern to hear the White House people use this kind of excuse for him: He doesn’t know, and we’ll have to let him know.
We have been pretty good at assessing where to find the problems. That is because most of the problems revolve around making the new law work in concert with the old law that has been in place since the individual mandate was a figment of Congress’ imagination.
The basic trouble is that the new law is a piece of legislation, and the old law is a regulation. The 30,000 pages of new law will not permit a kind of interdependency or interplay between the two bodies of law that exists in, say, gun control, where much of the legislation has been required by the Constitution.
Legislative policy was not supposed to be set in stone by a 300-page document, but it has been precisely that.
